First - When ordering, send us an email click Fill Out Form or call (519) 438-4422 We will then send you an email, confirming your order with instructions. Payment can also be made by Interac, cheque, cash, money order and credit card. Acceptance – Agreement Using our website, is acceptance of our Terms and Conditions for services, buying/purchasing of product(s), and the user (customer), is bond by our Terms and Conditions. Terms and Conditions may also be articulated elsewhere,   and do not limit our Terms and Conditions but augment their meaning and application. nel-ton Marketing and Services Ltd. may also be referred to as nel-ton and/or NMS hereinafter. "Customer" or "client" means the end user. The end user may also mean the one receiving an invoice for payment.  
Pricing is subject to change without notice. All information posted on our website shall be verified by the client before proceeding, and shall not be binding upon nel-ton Marketing and Services Ltd. in whole or in part. Photo's, pictures may not be an accurate representation of a product but provides a point of reference. All products ordered for the client are NOT SUBJECT TO CANCELLATION OR SUBJECT TO RETURN without written authorization. Contents of this site shall not be copied or reproduced in whole or in part, and is the property of nel-ton.  
All pricing shown is excluded of all taxes and freight/handling charges. Descriptions of products/services are correct to the best of our knowledge and accurate with the understanding no guarantee is offered. Since ALL products are ordered specifically for the client. Approximate delivery dates shall not be grounds for cancellation of an order, even if delivery of their product and/or service is beyond the estimated date provided initially. Updates will be provided to our customer, so that they are aware of the changes.
Warranties: ALL warranties are restrictive - they start and end with the manufacturer. NMS shall not under any circumstances assume liability for the manufacturer’s product and/or services. In no event shall NMS be liable for any damages resulting from loss of data, or use, lost profits, loss of anticipated savings or any incidental or consequential damage(s) whatsoever. Defective products shall be covered under the manufacturer’s warranty and terms/conditions of such warranties.   Up-Dates/Trade Marks NMS may from time to time revise the Terms and Conditions by updating this website. NMS logos are trademarks or service marks, registered or not, is the property of NMS. No one may interpret, to grant directly or indirectly the use of a trademark or service mark on this web site, or a third party site. Liability Owner(s), director(s), contracted personal, employees, and or agents shall not be responsible, under any circumstances or liable for any and all damages resulting from the use or attempted use of our website, or for its content or lack thereof, even if NMS is advised of the possibility of such damages.
Court Proceedings All court proceedings or matters of the courts shall be handled in London Ontario , Canada, within the Canadian judicial system. Credit Card Use Efforts are employed in attempting to safe guard use of credit cards, but no system is fool proof. Therefore, the client carries full responsibility when using any credit card for payment and/or any issues of identity theft. The rigour employed for protecting such transactions, are similar to companies selling online. To aid in security we use PayPal for processing. Once payment has been made the order can be processed. Orders in process are not subject to cancellation in whole or in part. There maybe a processing fee added to the clients bill due to the fact we are charged in accepting payment by credit card. A first time purchaser is normally subject to a credit card for payment although this may continue based upon NMS discretion.
Restrictions to our Website No company or persons shall commandeer NMS website, either for commercial and/or personal advantage. Linking our website to another regardless of the means taken, or redirecting our site is prohibited. NMS shall have the right to obtain compensation, seek damages, loss of profits and other remedies for such activity regardless of the circumstances. NMS website maybe linked to other sites based on written permission only from NMS.
Limitations of Liability NMS maximum responsibility shall not in any event exceed the total purchase price of the Products and/or Services ordered by the client/customer.
Collection of Payment The customer shall be responsible, liable, for any and all cost(s) incurred by NMS in any court action and/or collection, litigation costs and/or out of pocket expenses needed to obtain payment. Overdue accounts are charged 2% daily interest, with a compounded annual amount of 27%. NSF cheques or missed payments are subject to a $35.00 administration fee, plus bank charges. Interest is applied to the principal amount, even if a partial payment is made, to discourage the failure to make total payment of all charges on overdue accounts. Website purchases are payable upfront before shipment of product/services with a clearing time of one (1) week, for verification of payment.
Shipment Damage The customer is responsible or duty bound to file a claim for damage with the carrier. It is the customer’s responsibility to seek damages from the carrier. Replacement of product due to damage by the courier, is the responsibility of the carrier/courier and not with NMS.  Once damage has been verified, NMS will try to assist in bringing about some resolution to the matter, between the customer and the carrier.
Indemnity Customer will indemnify and hold us (and our officers, directors, agents, subsidiaries, joint ventures and employees), harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of this Agreement, or your violation of any law or the rights of a third party.
